Terms and conditions for costume registrations (March 2022)

Before you place an order for your desired section, read the Terms and Conditions carefully and agree to them. By registering you automatically agree to all Xquisite Mas terms and conditions without exemption as well as the Mas bands terms and conditions that the section is offered in. The terms and conditions are only relevant for the registration for costume parades and not to be applied on the online shop for merchandise products. In this contract there are three (3) parties mentioned. The first party is the section (Xquisite Mas, responsible for costume production), the second party is the Mas band ( depending on the parade, organisation responsible for the event) and the third party is the masquerader (costumer, that purchases the costume)

Terms and Conditions of Xquisite Mas Costumes

a) Registration for costumes

1. Contract between masquerader and Xquisite Mas

Once you order a costume, you enter a contract with Xquisite Mas (the section) as well as the Mas band of the parade and automatically agree to all terms and conditions. When you have made a down payment for your costume and received your order confirmation via Email, the contract is valid. You must be at least 18 years old in order to register.

Our costume registration is for the participation in your desired parade depending on the section you have chosen. A commercial purchase of a costume without taking part in any of the on the website listed parades is not possible, unless it is an order for an individual costume. For individual orders please contact Xquisite Mas. You will receive the terms and conditions with your order confirmation and an invoice via email. If you register on behalf of another person, you must ensure that the participant has also read and agreed to the terms and conditions.

2. Retention of title

The costumes remain our property until you have paid your costume fully and on time. If your costume is not paid on time, Xquisite Mas has the right to sell your costume to another masquerader without refunding you of your downpayment. The costume is yours once all payments are cleared and you signed and collected your costume.

The Mas band has the right to decline attendance and access to the section up to the day before the parade even after the costume has been paid if any behaviour damaging to the brand and cultural values of Xquisite Mas occur. In this case the Masquerader will receive a full refund and a lifelong ban to the Mas band. Absolutely no changes are to be made to any designs from the masquerader. If changes are being made it can lead to a ban for future registrations.

4. Prices, delivery expenses, cancellation, liability All prices are final, sales tax is not charged in accordance with § 19 Section 1 UStG of the German law.

Data communication over the Internet cannot always be guaranteed error free and / or available at the current state of the art. The provider is liable to the extent either for the continuous still uninterrupted availability of the website and the services offered there.

Custom made products like our costumes are excluded from the withdrawal. Therefore, it cannot be changed after the order is completed, neither size nor colour or section.

5. Costume Collection with each parade the section will have at least one pick up date depending on the parade the masquerader takes part on. The pickups will take part in the city of the parade. Dates of the pickups may vary but will always be announced via email and or on social media. In order to collect a costume, the masquerader will have to have a receipt and order confirmation of your costume order as well as a valid ID card. If the masquerader sends a representative to collect the costume on their behalf, that representative must have the receipt and the order confirmation of the costume as well as a copy of the ID card of the masquerader and a written and signed statement from the masquerader side that confirms, that the representative will collect the costume. The masquerader/representative needs to sign a written agreement that the costume is received with all pieces & accessories complete and nothing is missing (agreement of collection). Any defaults on the costume, that the masquerader wishes to be corrected, need to be communicated at collection. Only complete and signed costumes are being given out to masqueraders without exception. The costume remains property of the section until the masquerader has signed.

After costume collection the masquerader does not have the right to recall a costume or ask for changes. If there is anything our masqueraders would like to change then the section will do its best to fix it at the collection, however there is no guarantee for that. The section is not responsible for any damages that occur after collection and is not responsible to fix those.

6. Warranty The regulations by the law are effective.

The masquerader /representative is asked to verify that the purchased costumes at the pickup are complete and communicate obvious defects to us as soon as possible at collection. Any defaults and missing pieces of the costume that are not being communicated at that very moment, have no effect on warranty and are no reason for a monetary refund.

In case of defects the section/ Xquisite Mas will offer repair or replacement. At no point will there be any costumes shipped. In case of repair, the section does not need to bear the increased costs incurred by the shipment of the goods to a place other than the place of the pick-up, provided that the shipment does not match the intended use of the goods.

Due to supply constraints, the section reserves low add variation in the type of sizes, fabric and colour. The costumes may vary slightly from prototype due to supplies available at that given time. Please note also that costumes are handmade items and therefore variations in quality, execution and production are to be accepted and at no point reason for compensation, refund or exchange.

If in any case the section should fail to deliver the costume or parts of the costume (in exception of the reasons listed above), the section takes full responsibility for a refund or a partial refund. The Mas band is not responsible. Refunds will be only given out to the masquerader for the missing pieces only. The section can take up to 6 months to process and refund the masquerader. Full refunds are only possible if the Mas band fails to deliver the entire costume. The Mas band ticket however is not refundable under any circumstance.

7. Payment

The masquerader can choose between different payment options on the website. On registration, the masquerader automatically agrees to a down payment of at least 50% of the total price. Without any down payment the costume order is not secured, and the section will not be able to process the order. The remaining amount of the payment is to be paid usually about 6-8 weeks before the parade. The down payment amount and payment deadlines may vary but will always be communicated with the masquerader. The section or Mas band will announce the exact deadline for the final payments via email and on the social media channels. The down payment is nonrefundable. If you have paid in full and you cannot take part in the parade the amount is nonrefundable either.

The costume is to be worn at the parade that it was released for by the masquerader that registered and ordered the costume, reselling is not allowed.

If Xquisite Mas costumes are being sold on a third party platform, the section is not responsible for any refunds or technical errors during the process of registration & payment.

b) Participation on parades

8. The parades

The section is not responsible for anything considering the Event of the parade. This includes security, organisation, music, insurance matters as well as safety and health. This is the responsibility of the Mas band alone. The section will ensure to cooperate with reliable and great Mas bands that offer an all-inclusive experience if possible.

8.1 Every masquerader that registered and collected their costume will receive one band ticket per costume. This band ticket allows access to the event of the Mas band on the carnival parade. There is no access to the event without the band tickets. The section or the Mas band is not responsible for the loss of band tickets by the masqueraders and will not give out any further band tickets in that case.

8.2 The band ticket will be given out either with the costume pick up or at the truck before the parade. Further information will be given out to the masqueraders on time. Each masquerader will only have one wrist band.

8.3. The masquerader must follow the instructions and rules of the Mas band during the parade without exception. If the masquerader breaks rules /instructions by the Mas band, they can be expelled from the event. In this case there is also no entitlement for refunds.

8.4 Xquisite Mas is not responsible for anything considering the parade itself or the organisation part of the parade. The section is only responsible for producing and delivering the costume and band ticket to the masquerader. All other responsibilities are being taken care of by the Mas band or the Carnival Committee of the Parade.

8.5 Xquisite Mas is in no way responsible for any health issues or material damage that is happening during the road.

8.6 Should there be any cancellation or postponement of the parade by the government or local authorities due to unforeseen circumstances like a pandemic, war, weather conditions or any other reasons the section and the Mas band are not responsible. The entitlement of monetary refund does not apply in this case.

8.6 The section and the Mas band is allowed to expel and refuse entry and access of a masquerader to costume purchases and events if their behaviour is damaging to the brand and puts other masqueraders to risk.

9. Data privacy

At initiation, completion, execution and termination of a purchase contract data we collected, store and process in the framework of the statutory provisions.

When visiting our internet site the currently used IP-address, date and time, browser type and operating system of your PC, and the pages that are logged into will be protocoled. It is not possible nor intended to draw any inferences from personal data.

The personal data that the masquerader choose to stay, for example, with an order or send an e-mail (eg, name and contact details) will be processed only for correspondence with them, and only for the purpose for which the data has been provided for. The section and the Mas band gives your data only to the staff responsible for the delivery of mail order company, so far as is necessary for the delivery of the goods.

Data may also be exchanged between the Mas band and the section.

The section assures you, that they will not pass your personal data to third parties, moreover, unless they are legally obliged, or the masquerader has given specific permission. As far as the section take on implementation and management of manufacturing processes services of third parties, the provisions of the Data Protection Act (EU-Datenschutz-Grundverordnung -EU-DSGVO) are complied with.

9. Duration of storage Personal data which have been communicated to the section through the website or the Mas band are only stored until the purpose is fulfilled, for which they were entrusted to the section. As far as trade and tax retention periods must be observed, the duration of storage of certain data can be up to 10 years.

10. Rights Should the masquerader no longer agree with the storage of the personal data or these have become incorrect, the section will cause a corresponding transfer out within the framework of legal provisions, the deletion, correction or blocking of your data. Upon request, the masquerader will receive free information about all personal data that we hold about you. For questions regarding the collection, processing or use of your personal data, for information, correction, blocking or deletion of data you please contact the section.

11. Links to other websites If the section refers to the websites of third parties on their Internet site, or link, the section cannot accept any responsibility or liability for the accuracy or completeness of the contents and the data security of these sites. As the section has no influence on the compliance with data protection regulations by third parties. In this case the masquerader should consider separately the privacy statements of each offer.

12. Law applicable Only German law is due. Compared to a consumer this choice of law applies only to the extent, be characterised as required by legal provisions of the country in which he has his domicile or habitual residence restricted.
